So, where does the buck stop?

The Pressure Systems Regulations identify that if you are the owner or user of a compressed air system then you are responsible for it – the owner shall be responsible for portable systems and the user shall be responsible for installed systems.

Whereas an installed system is seen to be the responsibility of the user as he has day to day control of the operation of the pressure system and is in the best position to meet the requirements of the regulations, it is now the case that installed compressed air systems are also the subject of lease or hire agreements. The question, then, is who is responsible for meeting the requirements of the Pressure Systems Regulations? In the far flung reaches of the regulations is the little-read Schedule 2, succinctly entitled ‘Modification of duties in cases where pressure systems are supplied by way of lease, hire, or other arrangements’, where the contractual responsibilities are outlined.
